قَوْلُ الصَّحَابِي
English A Companion's statement
مَا نُقِلَ عَمَّنْ صَحِبَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ اجْتِهَادٍ فِي مَسْأَلَةٍ مِنْ مَسَائِلِ الدِّينِ.
English What has been transmitted from the Companions of the Prophet, may Allah's peace and blessings be upon him, of independent reasoning in one of the issues of the religion.
قَوْلُ الصَّحَابِي مَصْدَرٌ مِنْ مَصَادِرِ التَّشْرِيعِ الإسْلَامِي الثَّانَوِيَّةِ ، وَهُوَ مَا ثَبَتَ عَنْ أَحَدِ أَصْحَابِ النَّبِيِّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- مِنْ رَأْيٍ أَوْ فَتْوَى اجْتَهَدَ فِيهَا فِي أَمْرٍ مِنْ أُمُورِ الدِّينِ ، فَخَرَجَ مِنْ ذَلِكَ مَا رَفَعَهُ إِلَى النبي صلى الله عليه وسلم فَلاَ يُسَمَّى قَوْلَ الصَّحَابِي. وَقَوْلُ الصَّحَابِي لَهُ ثَلاَثَةُ أَقْسامٍ: الأَوَّلُ: أَنْ يَقُولَ الصَّحَابِي قَوْلاً فَيَنْتَشِرَ بَيْنَ الصَّحَابَةِ وَلَا يُعْرَفُ لَهُ مُخَالِفٌ، فَهَذَا يُسَمَّى: إِجْمَاعًا سُكُوتِيًا. الثَّانِي: أَنْ يَقولَ الصَّحَابِي قَوْلًا وَيَنْتَشَرَ فَيُخَالِفَهُ غَيْرُهُ مِنَ الصَّحَابَةِ رَضِيَ اللهُ عَنْهُمْ. الثَّالِثُ: أَنْ يَقولَ الصَّحَابِي قَوْلًا، وَلَا يَنْتَشِرُ فِي الأُمَّةِ، وَلَمْ يُوجَدْ لَهُ مُخَالِفٌ فِي الصَّحَابَةِ. وَالمُرادُ بِالصَّحَابِي: مَنْ لَقِيَ النَّبِيّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مُؤْمِنًا بِهِ، وَمَاتَ عَلَى الإسْلاَمِ.
English "َQawl as-Sahaabi" (a Companion's statement) is one of the secondary sources of Islamic legislation. It means an opinion or a fatwa that is authentically attributed to one of the Prophet's Companions about a matter pertaining to religion. There are three divisions of "qawl as-Sahaabi": First: a "Sahaabi" says something, and his statement spreads among the Sahaabah (Companions), and they do not oppose him. This is called "ijmaa‘ sukooti" (silent consensus). Second: a "Sahaabi" says something, and his statement spreads, and some of the "Sahaabah" oppose him. Third: a "Sahaabi" says something, but his statement does not spread in the "Ummah" (Islamic community), and none of the "Sahaabah" oppose him. A "Sahaabi" is someone who met the Prophet, may Allah's peace and blessings be upon him, while he believed in him and died as a Muslim.
يُطْلَقُ مُصْطَلَحُ (قَوْلِ الصَّحَابِي) فِي بَابِ صِيَغِ الأَمْرِ وَالنَّهْيِ ، وَبَابِ أَنواعِ الإِجْمَاعِ ، وَبَابِ الاجْتِهَادِ وَالتَّقْلِيدِ ، وَبَابِ القِيَاسِ.
